Welcome to Salty Nova. The terms "we", "us" and "our" refer to Salty Nova. Salty Nova operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Salty Nova is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced in them (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights, including how our liability to you is limited.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable consumer protection law. Where anything in these Terms conflicts with those rights, your statutory rights take precedence.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Section 1 — Access and account

By agreeing to these Terms of Service, you confirm that you are at least 18 years old, and that if you allow anyone under 18 to use the Services on a device you own or manage, you do so with your consent and take responsibility for their use.

To use the Services, including browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment and delivery details. You confirm that the information you provide is correct, current and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for activity on your account. You may not transfer, sell, assign or license your account to anyone else.

Section 2 — Our products

We make every effort to represent our products accurately. Colours and appearance may differ from how they look on your screen, depending on your device and its settings. Our products are handmade in small batches, so slight variation between individual items is normal and part of how they are made.

This does not affect your statutory right to receive goods that are of satisfactory quality, fit for purpose, and as described.

All product descriptions are subject to change without notice. We may discontinue any product at any time, and may limit the quantities we offer to any person or region.

Section 3 — Orders

When you place an order, you are making an offer to purchase. We may accept or decline your order. Your order is accepted when we send you confirmation that it has been dispatched, at which point a contract is formed between us. We must receive and process your payment before your order is accepted.

If we do not accept, change or cancel an order, we will contact you using the email address, billing address or phone number you provided. If we cancel an order after taking payment, we will refund you in full.

Your right to cancel. If you are a consumer, you have the right to cancel your order within 14 days of receiving it, for any reason and without giving a justification, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in this section limits that right. Returns and exchanges outside that period are handled in accordance with our Refund Policy.

Our products are intended for personal or household use. If you would like to stock Salty Nova products in a shop or resell them, please get in touch — wholesale is handled under a separate agreement.

Section 4 — Prices and billing

Prices are in pounds sterling and include VAT where applicable. Delivery charges are shown separately at checkout.

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect when you place your order, as set out in your order confirmation email.

From time to time we may run promotions governed by their own terms. Where those terms conflict with these Terms, the promotion terms apply to that promotion.

You agree to provide current, complete and accurate payment and account information, and to keep it up to date so we can complete your order and contact you if needed.

You confirm that the payment details you provide are correct, that you are authorised to use that payment method, and that you will pay the amounts due at the prices shown, including delivery and any applicable taxes.

Section 5 — Delivery

We aim to dispatch within the timescales shown in our Shipping Policy. Delivery estimates are estimates, not guarantees, and we are not responsible for delays caused by circumstances outside our reasonable control.

Your order is our responsibility until it reaches you. In line with the Consumer Rights Act 2015, goods remain at our risk until they come into your physical possession, or the possession of someone you have nominated to receive them. If your parcel is lost or damaged in transit, contact us and we will resolve it — you do not need to claim against the carrier yourself.

This does not apply where you arrange your own courier that we have not offered as a delivery option. In that case, the goods are at your risk from the point we hand them to your courier.

Section 6 — Intellectual property

Our Services, including all trade marks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by Salty Nova, its affiliates or its licensors, and are protected by UK and international intellectual property law. Our prints and pattern designs are original works owned by Salty Nova.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you a licence or other rights under any patent, trade mark, copyright or other intellectual property of Salty Nova, Shopify or any third party. All rights not expressly granted are reserved.

The Salty Nova name, logo, product names, designs and slogans are trade marks of Salty Nova. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trade marks of Shopify. All other names, logos and marks on the Services belong to their respective owners.

Section 7 — Optional tools

You may be given access to third-party tools as part of the Services, which we neither monitor nor control.

You acknowledge that we provide access to such tools "as is" and "as available", without warranties or endorsement of any kind. Your use of them is at your own discretion, and you should make sure you are familiar with the terms on which the relevant third party provides them.

We may offer new features through the Services in future. Those features will also form part of the Services and be subject to these Terms.

Section 8 — Third-party links

The Services may contain material and links to websites operated by third parties, including embedded third-party functionality. We are not responsible for reviewing or assessing the content or accuracy of third-party material or websites, and if you choose to visit them you do so at your own risk.

Please review the relevant third party's policies before entering into any transaction with them. Complaints, claims or questions about third-party products and services should be directed to that third party.

Section 9 — Relationship with Shopify

Salty Nova is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Salty Nova. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Salty Nova, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Salty Nova.

Section 10 — Privacy policy

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify and with third parties who may be located in countries other than the one you live in, in order to provide the Services to you. See our Privacy Policy for more detail on how we, Shopify and our partners use your personal information.

Section 11 — Feedback and customer content

If you submit, upload, post, email or otherwise send us any ideas, suggestions, feedback, reviews, photographs, proposals or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use — for example, sharing your photographs on our website or social channels.

You confirm that: (i) you own or have all necessary rights to the Feedback; (ii) you have disclosed any payment or incentive you received in connection with it; and (iii) it complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's rights.

You agree that your Feedback will not infringe any third party's rights, will not be unlawful, abusive or obscene, and will not contain any virus or malware. You may not use a false email address or impersonate anyone else. You are responsible for your Feedback and its accuracy, and we accept no liability for Feedback posted by you or any third party.

Section 12 — Errors, inaccuracies and omissions

Occasionally information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges, transit times or availability. We may correct any errors and update information at any time without prior notice, including after you have submitted an order.

If we discover an error in the price of something you have ordered, we will contact you before dispatch. You can choose to continue at the correct price or cancel. If we cannot reach you, we will cancel the order and refund you in full.

Section 13 — Prohibited uses

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, disparage or intimidate any person; (e) to transmit false or misleading information; (f) to send, receive, upload, download or reuse any material that does not comply with these Terms; (g) to send any unsolicited advertising or promotional material, including spam or chain letters; (h) to impersonate any other person or entity; or (i) to engage in any conduct that restricts or inhibits anyone else's use of the Services, or that may harm Salty Nova, Shopify or other users, or expose them to liability.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track other people's personal information; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data-gathering tool, AI tool (including agentic AI) or other automated or manual means to access the Services, except as permitted by Section 14; or (f) interfere with, bypass or circumvent any security or authorisation measures, robot exclusion headers, or other measures we use to restrict access.

We may suspend, disable or terminate your account at any time, without notice, if we determine that you have breached these Terms.

Section 14 — Agents

14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

Section 15 — Termination

We may terminate this agreement or your access to the Services at any time, and you will remain liable for any amounts due up to the date of termination. Where you are a consumer and we terminate without good reason, this does not affect any order already accepted.

The following sections continue to apply after termination: Intellectual Property, Feedback and Customer Content, Termination, Disclaimers, Limitation of Liability, Indemnity, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provision that by its nature should survive.

Section 16 — Disclaimers

Information presented on the Services — such as guides, blog articles and sizing advice — is provided for general information only. We do not warrant that it is complete or suitable for your particular circumstances, and any reliance you place on it is at your own risk.

The Services themselves are provided "as is" and "as available". We do not guarantee that the Services will be uninterrupted, timely, secure or error-free.

This section does not apply to the products we sell you. As a consumer you have statutory rights that we cannot exclude or restrict: goods we supply must be of satisfactory quality, fit for purpose, and as described. Nothing in these Terms limits those rights or your remedies if we fall short of them.

Section 17 — Limitation of liability

Nothing in these Terms excludes or limits our liability for:

death or personal injury caused by our negligence
fraud or fraudulent misrepresentation
breach of your statutory rights under the Consumer Rights Act 2015
defective products under the Consumer Protection Act 1987
anything else that cannot lawfully be excluded or limited

Subject to the above, and if you are a consumer:

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen, or if at the time the contract was made both we and you knew it might happen.

We do not supply our products for business use, and we have no liability for any loss of profit, loss of business, business interruption or loss of business opportunity.

If you are not a consumer, our total liability to you in connection with any order is limited to the amount you paid for that order.

Section 18 — Indemnity

If you are not a consumer, or if you use the Services in breach of Section 13 (Prohibited Uses), you agree to indemnify and hold harmless Salty Nova, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal costs, payable to a third party and arising out of (1) your breach of these Terms, (2) your breach of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any claim we seek to be indemnified for. We may control the defence and settlement of such a claim, but will not settle any claim that requires something of you other than payment without your consent, which you will not unreasonably withhold. You will cooperate in the defence of the claim.

Nothing in this section requires a consumer to indemnify us for ordinary use of the Services.

Section 19 — Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable part will be treated as severed. This will not affect the validity of the remaining provisions.

Section 20 — Waiver and entire agreement

If we fail to exercise or enforce any right or provision of these Terms, that is not a waiver of that right or provision.

These Terms, together with any policies posted on this site, form the entire agreement between you and us in relation to your use of the Services, and supersede any prior agreements or communications between us, including any earlier versions of these Terms.

Section 21 — Assignment

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer or assign these Terms and our rights and obligations under them, provided this does not affect your rights under these Terms.

Section 22 — Governing law and disputes

These Terms and any contract between us are governed by the law of England and Wales.

If you are a consumer, you may bring proceedings in the courts of England and Wales, or in the courts of the part of the UK where you live. If you live in Scotland you may bring proceedings in Scotland; if you live in Northern Ireland you may bring proceedings in Northern Ireland.

If something goes wrong, please contact us first at contact@saltynova.com — we would much rather resolve it directly. If we cannot resolve a complaint between us, you may be entitled to refer the dispute to an alternative dispute resolution provider. Nothing in this section affects your right to take a claim to court.

Section 23 — Headings

The headings in these Terms are for convenience only and do not affect their interpretation.

You can review the current version of these Terms at any time on this page.

We may update, change or replace any part of these Terms by posting the change on our website. Your continued use of the Services after a change is posted constitutes acceptance of that change. Changes will not apply retrospectively to an order we have already accepted.
